These Terms of Service ("Terms") govern your use of the Dent Shop Manager mobile application ("App") provided by Aaron's Hail Repair LLC ("Aaron's Hail Repair," "we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
You accept and agree to these Terms by:
Your use of the Dent Shop Manager App is also governed by our Privacy Policy, which can be found at Dent Shop Manager Privacy Policy. Please review the Privacy Policy to understand how we collect, use, and disclose your information.
You must be at least 18 years old or the legal age of majority in your jurisdiction to use the App. By using the App, you represent and warrant that you meet these requirements.
To use certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You agree not to:
4.1. Claims Administration Services: Dent Shop Manager may offer services that allow users to outsource the administration of their claims to our virtual team, subject to payment of applicable fees. When utilizing these services, please be aware of the following:
4.2. Disclaimer: While our team will assist you in managing your claims with insurance companies, we do not have control over factors beyond our control, including but not limited to insurance company representatives' actions or decisions, delays by insurance companies, or their third-party subcontracted estimating services. Therefore, we cannot be held responsible for any errors or omissions, including those related to payment details, made by insurance companies or their representatives. Additionally, we are not responsible for delays or losses resulting from delays if the user fails to receive the phone call from the adjuster, send their repair estimate or supplement to the insurance in a timely manner, or otherwise demonstrate incompetence in managing their business affairs effectively. Users paying for claims outsourcing are contracting our services to make a specified number of phone calls per claim. We fulfill our obligations by making those calls, and any issues arising thereafter that are beyond our control are not our responsibility.
4.3. User Responsibilities: Users utilizing our outsourcing services remain responsible for verifying and confirming the status and details of their claims directly with the insurance company. It is essential for users to review and verify any information provided by our team to ensure accuracy.
4.4. No Refunds: Aaron's Hail Repair LLC does not provide refunds for claims outsourcing services, regardless of the outcome or circumstances, including but not limited to delays or issues beyond our control.
4.5. Dispute Resolution: In the event of a dispute regarding the quality of our claims outsourcing services, we will carefully evaluate each claim, including the audio recordings of our virtual call center representatives when they made the call. If, upon review, we find that our representative demonstrated competence and adequately performed their job based on the information provided by the user, no refund will be given. However, if we determine that our representative did a poor job or demonstrated incompetence, we reserve the right, at our sole discretion, to provide a refund.
4.6. Sole Discretion: The decision to issue a refund in cases of dispute is at the sole discretion of Dent Shop Manager's team.
The Dent Shop Manager App and its content, including but not limited to text, graphics, logos, icons, images, audio, and software, are owned by Aaron's Hail Repair LLC or its licensors and are protected by intellectual property laws. You may not use, reproduce, distribute, or create derivative works based on the App without our express written consent.
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. Aaron's Hail Repair LLC disclaims all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the extent permitted by law, Aaron's Hail Repair LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, arising out of your use or inability to use the App.
These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from or related to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the federal and state courts located within the United States.
